COKENACH CRICKET CLUB
CONSTITUTION
The Club will be known as“Cokenach Cricket Club” and will be affiliated to the English and Welsh Cricket Board and the Local County Representative boards of the E.C.B.
AIMS AND OBJECTIVES
- To organise teams to play cricket in league, cup, and friendly matches for the benefit of the memberS
- To offer coaching and competitive and recreational opportunities in Cricket
- To promote both the Club and Cricket within the local community
- To encourage opportunity for all persons who want to play Cricket, regardless of sex, ability or ethnicity

To ensure a duty and care to all members of the club by adopting and implementing the E.C.B. Safe Hands and Welfare of Young People in Cricket Policy, and any future versions of the Policy.

To ensure a duty of care to all membersof the Club

To provide facilities and all its services in a way that is fair to everyone.

To ensure that all-present and future members receive fair and equal treatment.
MEMBERSHIP
Membership of the Club shall be open to all persons irrespective of ethnicity, nationality, sexual orientation, religion or beliefs; or of age, sex or disability except as a necessary consequence of the requirements of cricket as a particular sport.
The Management Committee may refuse membership, or expel from membership only for good and sufficient cause, such as conduct or character likely to bring the Club or Sport into disrepute. Appeal against such a decision may be made to the Club’s members and decided by a majority vote.
Membership shall consist of officers and members of the Club
All members will be subject to the regulations of the constitution and by joining the club will be deemed to accept these regulations and codes of conduct that the club has adopted
The categories of membership will be one of the following:
President
Vice Presidents
Life member
Full member
Junior member [up to the age of eighteen]
Each member over the age of eighteen is entitled to one vote at either a General meeting or Annual General Meeting or Extraordinary General meeting.
Any member guilty of misconduct as outlined in the Cokenach Cricket Club Disciplinary Code (see Appendix A), or who, in the opinion of the majority of the committee after due consideration, for any other cause is deemed to be unsuitable to continue membership of the club may be called upon by notice, by the secretary, to withdraw or resign. If in default of such withdrawal or resignation, at the expiration of seven days from the date of such notice, the person or persons to whom notice has been given shall cease to be a member and the name or names shall be removed from the books of the Club forthwith.
Any member feeling aggrieved by any such expulsion shall have the right of appeal to the members at an Extraordinary General Meeting which shall be summoned by the Secretary upon notice in writing from the aggrieved member that such appeal is requested. The members shall determine the outcome by majority vote which will be deemed to be final.
MEMBERSHIP FEES
Membership fees will be set annually by the committee and ratified at the Annual General Meeting.
Fees will be payable as agreed at the Annual General Meeting
Non-payment of membership fees by a member after a written final request for payment from the treasurer shall automatically terminate the member’s membership. The relevant committee shall have the power to allow a concession for non-payment in exceptional circumstances
COMMITTEE
The direction and management of the Club shall be in the hands of two committees elected annually at the Annual General Meeting.
The officers of the Club will be and will form the Management Committee

- Saturday Captain
- Saturday Vice Captain
- Sunday Captain
- Sunday Vice Captain
- Welfare Officer
- Member from the youth sub committee
- Member from the youth sub committee
The membership of the Youth Committee will be:
- The Club Chairman
- The Club Vice Chairman
- The Club Treasurer
- Coaches from the relevant year groups
- Managers from the relevant year groups
- Welfare Officer
- Parents representative
- Parents representative
[The relevant year groups are the ones being entered into league and cup competitions for that year]
Five members of the Management Committee shall form a quorum [quorum being half of, less one of the total officers]. The committee shall have the power to fill any casual vacancy thereon until the next Annual General Meeting
The Management Committee will have the powers to appoint sub committees as necessary and appoint advisers and co-opt members to the Management Committee as necessary to fulfil its business
Each committee will be responsible for the disciplinary hearings of members for whom it is responsible who infringe the club rules, regulations or constition. Each committee will be responsible for taking any actionof suspension or discipline following such hearings
INDEMNITY CLAUSE
The Committee shall not without the sanction of the Club in General Meeting have power to enter into any contract on behalf of the Club for a longer period than one year.
Members of the Committee, Club Officers and other members of the Club shall be indemnified out of the assets of the Club against any liabilities properly and bona-fide incurred by them on behalf of the Club, but only insofar as such liabilities and/or expenditure has been first approved by the Committee. No individual member, whether an Officer of the Club or a member of the Committee or not, has authority to enter into contracts or commitments on behalf of the Club, except with the approval of the Committee.
FINANCE
All monies of the Club shall be paid into an account held in the name of the Club
The Club Treasurer will be responsible for the finances of the Club
Cheques on the Clubs account shall be signed by the Treasurer and such other officer of the Club as may be appointed by the committee
The financial year shall close on 31st December in each year
The Treasurer shall keep a correct account of all monies received and paid on be half of the Club
The Committee will appoint an Auditor subject to the Auditor not being a member of the club
All surplus income or profits are to be reinvested in the Club. No surpluses or assets will be distributed to members or 3rd parties.
DISCIPLINE AND APPEALS
All complaints regarding the behaviour of members should be submitted in writing to the Secretary
The relevant committee will meet to hear complaints within twenty-one days of a complaint being lodged. The committee has the power to take appropriate disciplinary action including the termination of membership.
The outcome of a disciplinary hearing shall be notified in writing to the person who lodged the complaint and the member against whom the complaint was made within seven days of the hearing.
There will be a right of appeal to the Management Committee following disciplinary action being announced. The committee shall consider the appeal within twenty-one days of the Secretary receiving the appeal.
Any member feeling aggrieved by the outcome of the appeal has the right of appeal to the members at an Extraordinary General Meeting which shall be summoned by the Secretary upon notice in writing from the aggrieved member that such an appeal is requested
ANNUAL GENERAL MEETING
The Annual General Meeting of the Club shall be held after the termination of the financial year
Eight Days notice shall be given to all members along with notice of agenda , except members whose membership fees are out standing
All members are entitled to attend.
All members over the age of eighteen have one vote.
All members are entitled to stand for office
All members are entitled to speak
Notice of motions for the AGM must be sent to the secretary three days before the date of the meeting
The AGM shall:

Elect officers and representatives of the Club

Elect officers for the Management Committee and the Youth Committee

Hear and adopt reports from the Club

Decide policy matters for the coming year

Receive accounts
-
Consider Resolutions
-
Deal with General business
-
Adopt fee structure for the year
EXTRAORDINARY GENERAL MEETING
An Extraordinary General Meeting shall be summoned within twenty one days by the secretary on the instructions of the committee
Or on receiving notice of request signed by ten members of the Club
Or on receiving notice from half of the Management Committee or Youth Committee
Or in accordance with the appeal procedures as out lined
Eight days notice shall be given to members and the business of the meeting shall be specified in a convening notice
No other business may be dealt with at that meeting
Fifteen members present in person shall form a quorum
GENERAL MEETING
All members are entitled to attend
All members present over 18 years old are entitled to vote on any resolution
All members present are entitled to speak
All members present vote on the election of any officer except as otherwise specified in the rule A poll may be demanded by the Chairman or by any three members
Five members present in person shall form a quorum
DISSOLUTION
The Club may be dissolved only at an EGM specially convened by the secretary after a majority vote of members over 16 years old have passed the motion at the AGM.
If a majority of two thirds of the members over 16 years old present at the EGM pass the resolution .The committee shall thereupon, or at such future date as shall be specified in such a resolution, proceed to discharge all liabilities of the club and dispose of all property and assets of the club to a registered charitable organisation or the England & Wales Cricket Board for use by them for related community sports.
ALTERATIONS THE CONSTITUTION
The Constitution will only be changed through agreement by a majority vote at an AGM or EGM.
DISTRIBUTION OF THE CONSTITUTION
A copy of the constitution shall be made available to every member of the Club
Cokenach Cricket Club hereby adopts and accepts this constitution as a current guide regulating the actions of the members
